اوپر ہم نے وہ ریمارک نقل کیا ہے جو ہند ستانی سپریم کورٹ کے سابق چیف جسٹس مسٹر وائی وی چندر ا چوڑنے اس معاملہ میں  محمد احمد­ شاہ بانوکیس پر فیصلہ صادر کرتے ہوئے دیا تھا۔ اس سلسلہ میں  ہم نے سابق چیف جسٹس صاحب کو ایک خط روانہ کیا تھا۔ اس خط كو يهاں نقل کیا جارہاہے:

Dear Mr. Chandrachud,

I am taking the liberty of addressing myself to you because on going through your verdict on the Muhammad Ahmed-Shah Bano case. I find that one of the statements you make casts unfair aspersions on Islam. You allege that women have been ‘traditionally’ subjected to unjust treatment, and that the ‘fatal point in Islam is the degradation of woman’. To support this, you quote Menu as having stated that woman did not ‘‘deserve independence’’, and the Prophet of Islam as having said, ‘‘Woman was made from a crooked rib, and if you try to bend it straight it will break; therefore, treat your wives kindly.’’

While Manu's statement bears out your statement, I must point out that you have badly misquoted the Prophet. Nowhere in the Hadith is it stated that woman was made from a crooked rib, this being an ancient. Biblical version of God's creation of human life. The word 'rib' was used by the Prophet in a purely metaphorical sense and his actual words were: ‘‘Woman is like a rib, if you try to straighten her out, it will break, so treat her kindly.’’

The Encyclopoaedia Brittanica states: ‘‘With respect to personality traits, man are characterized by greater aggressiveness, dominace and achievement, motivation, women by greater dependency, stronger social orientation and the tendency to be more easily discouraged by failure than men (19/907)’’.

Presumably the Prophet, with his great understanding of human nature had a fine intuitive grasp of the fundamental biological and psychological differences between men and women particularly the latters’ fragility and passivity and, for this reason, found it necessary to admonish lesser men to treat wives kindly.

I fail to see how ‘‘the degradation of women’’ can ensue from such an injunction.

It would only be fitting, to say the least, if you were now to contract, or amend, your statement, now that this point has been clarified.

جیسا کہ پچھلی بحث سے واضح ہے۔ چیف جسٹس صاحب کا یہ ریمارک خالص علمی اعتبار سے سراسر بے بنیاد ہے۔ مگر اس سے زیادہ عجیب بات یہ ہے کہ مو صوف کو جب بذریعہ خط توجہ دلائی گئی تو انھوں نے اس کا جواب دینے کے بجائے خاموشی اختیار کر لی۔ پہلی باریہ خط انھیں 17 اپر یل1986کو بذریعہ رجسٹری روانہ کیا گیا تھا۔ جب کو ئی جواب موصول نہ ہوا تو دوبارہ یہی خط 14 مئی 1986 کو انھیں بھیجا گیا۔ پھر بھی انھوں نے کوئی جواب نہیں دیا۔ باربار ٹیلی فون کرنے کے بعد بھی کوئی کامیابی نہ ہوسکی۔ ٹیلی فون پر ان سے کہا گیا کہ آپ ملاقات کا وقت دیدیں تاکہ ہم خود گفتگو کے لیے آپ کے یہاں حاضر ہوسکیں۔ مگر انھوں نے ملاقات کا وقت دینے سے معذوری ظاہرکی۔ مجبوراًاب یہ خط اس طرح شائع کیا جارہا ہے کہ اس کے ساتھ جسٹس موصو ف کا جواب شامل نہیں۔

دوسروں پر حکم لگا نے کے لیے ہر آدمی با انصاف ہے۔ مگر جب خود اپنے آپ پر حکم لگانا ہو تو ہر آدمی بے انصاف بن جاتاہے۔
